“we”, “our” or “us”. Registered purchasing customers are mentioned
as “you” or “your”.
Q:
What does
the name “5000 / 5” stand for, and what are the official prize competition
dates?
A:
The name stands for the first 5000 pre-release books sold around the
world, in order for those registered customers to receive 5 (five)
chances in the prize competition. The competition runs from 1 January
2007 through to 31 December 2007.

to check if your purchase qualifies for 5 chances to win…..we update
the thermometer constantly. Registered customers who purchase after
the initial 5000 books sold will receive 1 (one) chance in the prize
competition for each purchase.
Q:
What are
the competition prizes?
A:
We are offering our registered purchasing customers the chance to
win one of 5 (five) US $1,000 prizes of golf equipment. The equipment
shall be chosen by each prize winner and custom fitted at the nearest
location of the prize winner’s retailer of choice by the author (upon
request).
The
5 golf equipment prizes will be separated, being two prizes set aside
for customers who purchase the North American edition of the book
series (US or Canadian resident), one for a British resident, one
for the German edition (German/Austrian/Swiss or French resident)
and one for an International prize winner living outside of those
above-mentioned areas.
Q:
How can
I enter and qualify to win?
A:
You need to purchase one of the two printed editions (North American
or German) of the book Buying Golf Equipment

Our
website is currently the sole official retailer and distributor of
the book (printed) in all language editions. If you purchase the printed
edition of the book by credit card / debit card from our website,
you will be making your payment via an official partner, PayPal®,
who are the undisputed leaders in secure, encrypted online payment
transactions. Once your transaction is completed, your name and contact
details will be recovered by Arden & Fogarty LLC and entered into
the prize competition. We keep no details of your credit card / debit
card number whatsoever, as per our agreement with PayPal®.
We will keep and maintain only your contact details for this prize
competition, details that are printed and locked away in a bank safe,
not on computer file. We never provide your contact details to anyone.
If
you decide to make payment for your book(s) by (cheque) check; then
we register you for the prize competition within 24 hours of your
check clearing our company bank account. We will keep and maintain
only your contact details for this prize competition, details that

We will notify the winners by registered post and telephone (where
available) within 7 (seven) days of the prize draw taking place on
1 January 2008. Prizes must be claimed within 31 (thirty-one) days
of registered notification by us, otherwise an official re-draw of
that particular prize will take place. After every prize has been
claimed and arrangements / custom fitting dates / completion have
been made, all customer contact details will be physically destroyed
by our director.

What are
the prize competition rules?

Please
note that our prize competition is open to registered customers -
regardless of their residency - who purchases the paperback edition
of the book Buying Golf Equipment - the
step-by-step guide in any available language version.
For
all prize winners residing outside of the USA, the local currency
equivalent of US $1,000 will be determined by Arden & Fogarty
LLC at the time of an official prize winning notification. The prizes
will amount to US $1,000 (or the local currency equivalent) including
local sales taxes, for all goods purchased. The prize winner will
be liable for excess payment of golf equipment in any instance where
the total amount registers beyond the above mentioned amount.
Entry
to the competition is strictly closed to all employees (current) of
the following companies and foundations, as well as individuals mentioned
here:
Arden
& Fogarty LLC, any golf equipment manufacturing company / distributor
/ agency or retailer, Mark D. Wilson, Thomson Press, Friesens Corporation,
Starlight Children’s Foundation UK, any breast cancer foundations,
any public library institutions, the contest judging organization,
together with all of their immediate families and those with whom
they are domiciled.
Please
read the above rules in their entirety before entering the prize competition.
Please do not enter the competition unless you agree to those rules.
Participation in the competition constitutes full and unconditional
agreement and acceptance of these rules, which are final on all matters
relating to the prize competition. All prize winners must be able
to confirm their registered address and identity, by producing legitimate
identification at the request of any official, identifiable employee
of Arden & Fogarty LLC. Our decision on all winners, being the
official prize competition judges, is final and no correspondence
will be entered into.
Q: Can I enter the prize competition
more than once?
A:
Yes. Multiple book purchases from a registered customer, using the
same payment method, will be rewarded with the appropriate amount
of chances to win.
Q: If I win a prize, am I responsible
for any relevant import duties or taxes?
A:
Import duties,
where applicable, are pre-paid by the official distributor of the
golf equipment brand(s) the prize winner would choose and receive.
The prize winner would be liable to pay normal sales taxes applicable
to retail golf equipment in their area of residence. In the event
of winning a prize in this competition, we strongly advise that prize
winners investigate local regulations with regards to paying income
taxes on prize winnings received, as all prize winners are solely
responsible for that circumstance.
Q:
Are any
of the prizes exchangeable for cash or other goods to the same value?
A:
No they are not. However, should you win a prize and decline to receive
it for your personal use; then it can be offered to another person
of your nomination; as long as that person’s identity is confirmed
by us and arrangements can be made to customize and / or deliver that
prize.

COMPETITION LIABILITY DISCLAIMER
Arden
& Fogarty LLC, PayPal® and any affiliated
prize suppliers, their directors, officers, partners, dealers and
employees shall not be responsible for any injuries, loss or damages
of any kind (compensatory, direct, incidental, consequential or otherwise)
with respect to, or in any way arising from, this prize competition
or the prize awarded, including but not limited to (i) lost, stolen,
not received, destroyed, damaged, misdirected, illegible, incomplete,
fraudulent or late entries which will be void and not eligible; (ii)
failure to receive entries for any reason or technical failures or
errors of any kind, including but not limited to incorrect or inaccurate
capture or loss of entry information, omissions, lost / delayed /
garbled data, transmission failure, interruption, deletion, defect
or failures of any telephone or computer line or network, computer
equipment, servers, or software, traffic congestion on the internet
or any website or any other online communication problems or any combination
thereof; (iii) seeding or printing or typographical errors in any
competition related material or human error; or (iv) any injury or
damage to participants' or any other persons' computer system(s) due
to viruses or otherwise or breaches of privacy due to interference
by third party computers. A prize winner's refusal or inability to
accept the prize awarded shall release Arden & Fogarty LLC and
the competition prize suppliers from all obligation. In no event shall
Arden & Fogarty LLC and the competition prize suppliers be held
to award more prizes than what is mentioned in these rules, or to
award prizes otherwise than in compliance with these rules.
